A homeworker is any person who : 1° Carries out work entrusted to them either directly or through an intermediary, on behalf of one or more establishments, in return for flat-rate remuneration; 2° Works either alone or with his or her spouse, partner in a civil solidarity pact, cohabitee or dependent children within the meaning ofarticle L. 313-3 of the Social Security Code, or with an auxiliary. Anyone who supplies all or part of the raw materials at the same time as the work, when these raw materials are sold to him by a client who then acquires the manufactured object or by a supplier indicated by the client and to whom the worker is obliged to go, retains the status of homeworker.
When home workers work in the same premises to perform complementary tasks, they acquire the status of workshop employees. These provisions do not apply when the homeworker works with his or her spouse, partner in a civil solidarity pact, cohabitee or with his or her children, under the conditions set out in 2° of Article L. 7412-1.
The client is responsible for applying all the legal provisions applicable to employees to the homeworker, even if it uses an intermediary.
The homeworker benefits from the provisions of the collective bargaining agreement binding the employer, unless otherwise stipulated in the relevant collective bargaining agreement.
At the client’s request, a declaration must be sent to the labour inspectorate referred to in Article L. 8112-1 as soon as the client begins or ceases to have home-based work carried out.
A homeworker who uses the services of an auxiliary is responsible for applying to the auxiliary all the legal provisions applicable to employees, subject to the application of articles L. 8232-1 to L. 8232-3 relating to the obligation and financial solidarity of the principal.
When a client uses a homeworker, he draws up a report or logbook. A Conseil d’Etat decree sets out the conditions under which this bulletin or booklet is drawn up. In particular, it specifies the information that must be included: 1° When the work to be carried out in the home is handed over ; 2° On delivery of the completed work.
