Article L7422-9 of the French Labour Code

When the deadlines set by the client for delivery of the work require the homeworker to extend his activity beyond eight hours per working day, the rate for performance shall be increased, unless a collective labour agreement or arrangement stipulates otherwise:

1° by at least 25% for the first two hours worked ;

2° By at least 50% for the following hours.

The entitlement of the persons concerned to these increases is assessed on the basis of the working hours defined in accordance with article L. 7422-6, and taking into account, where applicable, the assistance to which the homeworker may have recourse, in accordance with 2° of article L. 7412-1.

Lorsque les délais fixés par le donneur d’ouvrage pour la remise du travail imposent au travailleur à domicile de prolonger son activité au-delà de huit heures par jour ouvrable, le tarif d’exécution est majoré, sauf stipulation plus favorable d’une convention ou d’un accord collectif de travail :

1° De 25 % au minimum pour les deux premières heures ainsi accomplies ;

2° De 50 % au minimum pour les heures suivantes.

Le droit des intéressés à ces majorations est apprécié sur la base des temps d’exécution définis conformément à l’article L. 7422-6, et compte tenu, le cas échéant, des concours auxquels le travailleur à domicile peut recourir, conformément au 2° de l’article L. 7412-1.
