Article L7313-6 of the French Labour Code

The employment contract may, for its duration, prohibit the traveller, sales representative or sales agent from representing specific companies or products.

Where the employment contract does not contain such a prohibition, it shall contain, unless the parties expressly agree otherwise, a statement of the companies or products that the traveller, sales representative or sales agent already represents and an undertaking not to take on any new representation during the term of the contract without the employer’s prior authorisation.

Le contrat de travail peut, pour sa durée, prévoir l’interdiction pour le voyageur, représentant ou placier, de représenter des entreprises ou des produits déterminés.

Lorsque le contrat de travail ne prévoit pas cette interdiction, il comporte, à moins que les parties n’y renoncent par une stipulation expresse, la déclaration des entreprises ou des produits que le voyageur, représentant ou placier représente déjà et l’engagement de ne pas prendre en cours de contrat de nouvelles représentations sans autorisation préalable de l’employeur.
