Article L712-10 of the French Commercial code

Any establishment in the network is obliged to grant protection to the chairman, treasurer, the elected representative deputising for them or having received a delegation from them or a former elected representative who has left these functions, when the person in question is the subject of criminal proceedings in connection with acts not having the character of misconduct detachable from the exercise of his functions.

This protection is also due as a result of violence, threats or insults of which the same persons may be victims during or as a result of their duties and includes the obligation to compensate, where appropriate, the resulting damage.

The establishment is subrogated to the rights of the victim to obtain from the perpetrators of these offences the restitution of sums paid to the elected official or former elected official concerned.

Tout établissement du réseau est tenu d’accorder sa protection au président, au trésorier, à l’élu les suppléant ou ayant reçu une délégation de leur part ou à un ancien élu ayant quitté ces fonctions, lorsque la personne en cause fait l’objet de poursuites pénales à l’occasion de faits n’ayant pas le caractère de faute détachable de l’exercice de ses fonctions.


Cette protection est également due du fait des violences, menaces ou outrages dont les mêmes personnes peuvent être victimes à l’occasion ou du fait de leurs fonctions et comporte l’obligation de réparer, le cas échéant, le préjudice qui en résulte.


L’établissement est subrogé aux droits de la victime pour obtenir des auteurs de ces infractions la restitution des sommes versées à l’élu ou ancien élu intéressé.
