The collective agreements and agreements mentioned in 6° of article L. 711-16 are negotiated and signed by the President of CCI France, in compliance with the guidelines set by its Steering Committee, on behalf of CCI France and on behalf of the regional chambers of commerce and industry, under the conditions provided for in Article L. 2232-12 of the Labour Code.
The procedures for filing these agreements and conventions are those provided for in Section 3 of Chapter I of Title III of Book II of Part Two of the same Code.
Where these agreements and arrangements so provide, their stipulations replace, as the case may be, the provisions of the statutes governing the administrative staff of the chambers of commerce and industry or the stipulations of national or regional agreements having the same object.
The representativeness of trade union organisations at national level is assessed in accordance with the rules defined in articles L. 2122-1 to L. 2122-3 of the said code, by adding together all the votes cast in elections for their social and economic committees by staff directly employed by CCI France and the regional chambers of commerce and industry.
By-elections may be organised under the conditions set out in Article L. 2314-10 of the same code.
The results obtained in such elections may not have the effect of modifying the measure of representativeness calculated at the last general elections. This is established for the entire duration of the electoral cycle.
