Article L712-8 of the French Intellectual Property Code

The applicant may request that a trade mark be registered notwithstanding opposition to it if he can show that such registration is indispensable for the protection of the trade mark abroad.

If the opposition is subsequently found to be well founded, the registration decision shall be reversed in whole or in part.

Le déposant peut demander qu’une marque soit enregistrée nonobstant l’opposition dont elle fait l’objet s’il justifie que cet enregistrement est indispensable à la protection de la marque à l’étranger.

Si l’opposition est ultérieurement reconnue fondée, la décision d’enregistrement est rapportée en tout ou partie.
