I.-Where the activity of entrepreneur of live performances is exercised by a natural person, that person is required to fulfil conditions of competence or professional experience.
When the activity of entrepreneur of live performances is exercised by a legal entity, the legal representative or any other person designated by the structure is required to fulfil conditions of competence or professional experience.
If, during the period of validity of the declaration, the person required to fulfil the conditions of competence or experience referred to in the second paragraph ceases to hold office, the performance promoter must inform the administration of this, as well as the name and qualifications of the person replacing him/her. The authorities may then, if they consider that the conditions of competence or experience are no longer met, object to the continuation of the activity and terminate the validity of the declaration under the conditions and within the deadlines set by the decree provided for in article L. 7122-17.
II-The person making the declaration must not have been the subject of a court order prohibiting him/her from carrying out a commercial activity and must be registered in the Trade and Companies Register or in the National Register of Companies as a company in the trades and crafts sector when he/she is subject to this obligation.
III – The declaration of activity as a live performance company establishes that the obligations relating to the safety of performance venues have been complied with.
