Councillors to the Assembly of French Guiana benefit each year from an individual right to training calculated in euros, which may be accumulated over the entire term of office within the limit of a ceiling and the annual amount of which is set for a period of three years. It is financed by a compulsory contribution, the rate of which may not be less than 1%, deducted from the functional allowances received by councillors at the Assembly of French Guyana under the conditions set out in article L. 1621-3.
The implementation of the individual right to training is at the initiative of each of the elected representatives and may concern training unrelated to the exercise of the mandate. Such training may, in particular, contribute to the acquisition of the skills required for professional reintegration at the end of the term of office when the elected representative has not settled his pension rights in respect of his professional activity.
To ensure the financing of training, the individual right to training may be supplemented, at the request of its holder, by additional rights that may be financed by the local authorities in accordance with the terms and conditions defined in articles L. 2123-12, L. 3123-10, L. 4135-10, L. 7125-12 and L. 7227-12. When a training course contributes to his professional reintegration, the elected representative may contribute to its financing by mobilising his personal activity account mentioned in article L. 5151-1 of the Labour Code and article 22 ter of law no. 83-634 of 13 July 1983 on the rights and obligations of civil servants, when he has monetisable rights. The employee may also contribute to the financing of the programme by making a personal contribution in addition to the sums committed under the individual training entitlement. These additional contributions are not taken into account in the methods for calculating the amount of the individual right to training for elected representatives defined in the first paragraph of this article.
A decree in the Council of State determines the methods for calculating, capping as well as implementing the individual right to training.
