Article L713-3-3 of the French Intellectual Property Code

Where there is a risk of infringement of its rights, pursuant to articles L. 713-2 to L. 713-3-1, as a result of use in the course of trade for goods or services, of packaging, labels, markings, security or authentication devices or any other medium on which the trade mark is affixed, the proprietor of a trade mark may prohibit:

1° The affixing of a sign identical or similar to the trade mark on the media mentioned in the first paragraph;

2° The offering, placing on the market or possession for these purposes, import or export of the same media.

Lorsqu’il existe un risque d’atteinte à ses droits, en application des articles L. 713-2 à L. 713-3-1, du fait de l’usage dans la vie des affaires pour des produits ou services, de conditionnements, d’étiquettes, de marquages, de dispositifs de sécurité ou d’authentification ou de tout autre support sur lequel est apposée la marque, le titulaire d’une marque peut interdire :

1° L’apposition d’un signe identique ou similaire à la marque sur les supports mentionnés au premier alinéa ;

2° L’offre, la mise sur le marché ou la détention à ces fins, l’importation ou l’exportation des mêmes supports.
