Article L714-8 of the French Intellectual Property Code

Owners of trade marks reproducing or imitating the emblem of the Third Protocol Additional to the Geneva Conventions of 12 August 1949, and relating to the Adoption of an Additional Distinctive Emblem, or the name of that emblem, may continue to exploit their rights provided that they were acquired before 8 December 2005 and that their use cannot appear, in time of armed conflict, to be intended to confer protection under the Geneva Conventions and, where applicable, the Additional Protocols of 1977.

Les titulaires de marques reproduisant ou imitant l’emblème du troisième protocole additionnel aux conventions de Genève du 12 août 1949 relatif à l’adoption d’un signe distinctif additionnel ou la dénomination de cet emblème peuvent continuer à exploiter leurs droits à condition que ceux-ci aient été acquis avant le 8 décembre 2005 et que leur usage ne puisse apparaître, en temps de conflit armé, comme visant à conférer la protection des conventions de Genève et, le cas échéant, des protocoles additionnels de 1977.
