Article L716-2-8 of the French Intellectual Property Code

The proprietor of an earlier right who has tolerated for a period of five consecutive years the use of a later trade mark registered with knowledge of such use shall no longer be entitled to apply for a declaration of invalidity of the later trade mark on the basis of Article L. 711-3, in respect of the goods or services for which the use of the trade mark was tolerated, unless the registration of the latter was applied for in bad faith.

Le titulaire d’un droit antérieur qui a toléré pendant une période de cinq années consécutives l’usage d’une marque postérieure enregistrée en connaissance de cet usage n’est plus recevable à demander la nullité de la marque postérieure sur le fondement de l’article L. 711-3, pour les produits ou les services pour lesquels l’usage de la marque a été toléré, à moins que l’enregistrement de celle-ci ait été demandé de mauvaise foi.
