Article L721-4 of the French Code governing the entry and residence of foreign nationals and the right of asylum

The administrative authority may designate as the country of return:
1° The country of which the foreign national is a national, unless the French Office for the Protection of Refugees and Stateless Persons or the National Court of Asylum has recognised him as a refugee or granted him the benefit of subsidiary protection or if a decision has not yet been taken on his application for asylum ;
2° Another country for which a valid travel document has been issued under a European or bilateral readmission agreement or arrangement;
3° Or, with the foreign national’s agreement, any other country in which he or she is legally admissible.
A foreign national may not be removed to a country if he establishes that his life or freedom are threatened there or that he would be exposed to treatment contrary to the stipulations of article 3 of the European Convention for the Protection of Human Rights and Fundamental Freedoms of 4 November 1950.

L’autorité administrative peut désigner comme pays de renvoi :
1° Le pays dont l’étranger a la nationalité, sauf si l’Office français de protection des réfugiés et apatrides ou la Cour nationale du droit d’asile lui a reconnu la qualité de réfugié ou lui a accordé le bénéfice de la protection subsidiaire ou s’il n’a pas encore été statué sur sa demande d’asile ;
2° Un autre pays pour lequel un document de voyage en cours de validité a été délivré en application d’un accord ou arrangement de réadmission européen ou bilatéral ;
3° Ou, avec l’accord de l’étranger, tout autre pays dans lequel il est légalement admissible.
Un étranger ne peut être éloigné à destination d’un pays s’il établit que sa vie ou sa liberté y sont menacées ou qu’il y est exposé à des traitements contraires aux stipulations de l’article 3 de la Convention européenne de sauvegarde des droits de l’homme et des libertés fondamentales du 4 novembre 1950.
