Article L722-5 of the French Commercial code

When the impediment that gave rise to the transfer has ceased, the Court of Appeal, at the request of the Public Prosecutor, sets the date from which the Commercial Court will again hear the cases within its jurisdiction. On that date, the cases are transferred as they stand to the Commercial Court. However, the referring court continues to hear conciliation cases and, where a decision is taken on the merits, cases other than those relating to safeguard, receivership, judicial liquidation, judicial settlement and liquidation of assets.

Lorsque l’empêchement qui avait motivé le renvoi a cessé, la cour d’appel, saisie sur requête du procureur général, fixe la date à partir de laquelle le tribunal de commerce connaît à nouveau des affaires de sa compétence. A cette date, les affaires sont transmises, en l’état, au tribunal de commerce. Le tribunal de renvoi reste toutefois saisi des affaires de conciliation et, lorsqu’il est statué au fond, des affaires autres que celles de sauvegarde, de redressement, de liquidation judiciaires, de règlement judiciaire et de liquidation de biens.
