Article L7253-4-1 of the French General Code of Local Authorities

In the areas of competence of the territorial collectivity of Martinique, the President of the Executive Council of Martinique may, for the duration of the exercise of his functions, draw up a regional cooperation framework programme specifying the nature, purpose and scope of the international commitments that he proposes to negotiate, in compliance with the international commitments of the Republic, with one or more States, territories or regional bodies mentioned in Article L. 7253-3.

The President of the Executive Council of Martinique submits this framework programme to the deliberation of the Assembly of Martinique, which may then request, in the same deliberation, that the authorities of the Republic authorise the President of the Executive Council to negotiate the agreements provided for in this framework programme.

When this authorisation is expressly granted, the President of the Executive Council of Martinique may enter into the negotiations provided for in the framework programme. He shall inform the authorities of the Republic which, at their request, shall be represented at the negotiations.

The President of the Executive Council of Martinique shall submit any amendments to his framework programme for deliberation by the Assembly of Martinique. These modifications are approved by the authorities of the Republic, under the same conditions as the initial procedure.

At the end of the negotiations, the draft agreement is submitted to the deliberation of the Executive Council of Martinique for acceptance. The authorities of the Republic may then, subject to compliance with its international commitments, give power to the President of the Executive Council of Martinique for the purposes of signing the agreement.

Dans les domaines de compétence de la collectivité territoriale de Martinique, le président du conseil exécutif de Martinique peut, pour la durée de l’exercice de ses fonctions, élaborer un programme-cadre de coopération régionale précisant la nature, l’objet et la portée des engagements internationaux qu’il se propose de négocier, dans le respect des engagements internationaux de la République, avec un ou plusieurs Etats, territoires ou organismes régionaux mentionnés à l’article L. 7253-3.

Le président du conseil exécutif de Martinique soumet ce programme-cadre à la délibération de l’assemblée de Martinique, qui peut alors demander, dans la même délibération, aux autorités de la République d’autoriser le président du conseil exécutif à négocier les accords prévus dans ce programme-cadre.

Lorsque cette autorisation est expressément accordée, le président du conseil exécutif de Martinique peut engager les négociations prévues dans le programme-cadre. Il en informe les autorités de la République qui, à leur demande, sont représentées à la négociation.

Le président du conseil exécutif de Martinique soumet toute modification de son programme-cadre à la délibération de l’assemblée de Martinique. Ces modifications sont approuvées par les autorités de la République, dans les mêmes conditions que la procédure initiale.

A l’issue de la négociation, le projet d’accord est soumis à la délibération du conseil exécutif de Martinique pour acceptation. Les autorités de la République peuvent ensuite donner, sous réserve du respect des engagements internationaux de celle-ci, pouvoir au président du conseil exécutif de Martinique aux fins de signature de l’accord.
