Martinique is a territorial collectivity of the Republic governed by Article 73 of the Constitution, which exercises the powers attributed to an overseas department and an overseas region and all the powers devolved to it by law to take account of its particular characteristics and constraints.
The territorial collectivity of Martinique succeeds the department of Martinique and the region of Martinique in all their rights and obligations.
The determination and transfer of the administrative centre of the territorial collectivity of Martinique is decided by decree in the Conseil d’Etat, after consultation with the Assembly of Martinique and the municipal councils of the communes concerned.

The organs of the territorial collectivity of Martinique comprise the Assembly of Martinique and its President, the Executive Council of Martinique and its President, assisted by the Economic, Social, Environmental, Cultural and Education Council of Martinique.
No person may at the same time be a councillor of the Assembly of Martinique or an executive councillor of Martinique and a member of the Economic, Social, Environmental, Cultural and Education Council of Martinique.
The composition of the Assembly of Martinique and the term of office of councillors to the Assembly of Martinique are determined by the Chapter I of Title II of Book VI bis of the Electoral Code.
When a councillor to the Martinique Assembly resigns, he shall send his resignation to the President of the Martinique Assembly, who shall immediately notify the representative of the State in the territorial collectivity.
Any councillor to the Assembly of Martinique who, without a valid excuse, has refused to carry out one of the functions devolved upon him by the laws shall be declared to have resigned by the Council of State. The refusal results either from an express declaration addressed to those entitled or made public by its author, or from persistent abstention after warning from the authority responsible for convening. When the functioning of the Assembly of Martinique proves impossible, the Government may pronounce its dissolution by reasoned decree taken in the Council of Ministers; it shall inform Parliament of this as soon as possible. Dissolution may never be pronounced by way of a general measure.
