Article L7227-36 of the French General Code of Local Authorities

Subject to the provisions of the fourth paragraph of Article 121-3 of the Penal Code, the president of the assembly or a councillor deputising for him or her, the president of the executive council or an executive councillor may only be convicted on the basis of the third paragraph of that same article for unintentional acts committed in the exercise of his or her duties if it is established that he or she did not take the normal care in view of his or her competences, the power and means at his or her disposal and the difficulties specific to the missions entrusted to him or her by law.

The territorial collectivity of Martinique is obliged to grant its protection to the president of the assembly of Martinique, to the councillor deputising for him, to the president of the executive council or to the executive councillor or to one of these elected representatives who has ceased to hold office when the latter is the subject of criminal proceedings in connection with acts which do not have the character of misconduct detachable from the exercise of his functions.

Sous réserve des dispositions du quatrième alinéa de l’article 121-3 du code pénal, le président de l’assemblée ou un conseiller le suppléant, le président du conseil exécutif ou un conseiller exécutif ne peut être condamné sur le fondement du troisième alinéa de ce même article pour des faits non intentionnels commis dans l’exercice de ses fonctions que s’il est établi qu’il n’a pas accompli les diligences normales compte tenu de ses compétences, du pouvoir et des moyens dont il disposait ainsi que des difficultés propres aux missions que la loi lui confie.

La collectivité territoriale de Martinique est tenue d’accorder sa protection au président de l’assemblée de Martinique, au conseiller le suppléant, au président du conseil exécutif ou au conseiller exécutif ou à l’un de ces élus ayant cessé ses fonctions lorsque celui-ci fait l’objet de poursuites pénales à l’occasion de faits qui n’ont pas le caractère de faute détachable de l’exercice de ses fonctions.
