Article L7224-3 of the French General Code of Local Authorities

The office of councillor to the Martinique Assembly is incompatible with the office of executive councillor of Martinique.

Any councillor to the Martinique Assembly elected to the Martinique Executive Council has a period of one month from the date on which this election became final to resign his office as councillor to the Martinique Assembly or his office as executive councillor. He shall make his choice known in writing to the representative of the State in the territorial collectivity, who shall inform the president of the Martinique Assembly.

Failing to make an option within the time limit, he shall be deemed to have resigned his mandate as councillor to the Assembly; this resignation shall be recorded by order of the representative of the State in the territorial collectivity.

Le mandat de conseiller à l’assemblée de Martinique est incompatible avec la fonction de conseiller exécutif de Martinique.

Tout conseiller à l’assemblée de Martinique élu au conseil exécutif de Martinique dispose d’un délai d’un mois à partir de la date à laquelle cette élection est devenue définitive pour démissionner de son mandat de conseiller à l’assemblée de Martinique ou de sa fonction de conseiller exécutif. Il fait connaître son choix par écrit au représentant de l’Etat dans la collectivité territoriale qui en informe le président de l’assemblée de Martinique.

A défaut d’option dans le délai imparti, il est réputé démissionnaire de son mandat de conseiller à l’assemblée ; cette démission est constatée par arrêté du représentant de l’Etat dans la collectivité territoriale.
