The President of the Assembly of Martinique, the Vice-Presidents, the President of the Executive Council and the Executive Councillors shall, in the course of their duties, benefit from protection organised by the territorial collectivity in accordance with the rules laid down by the Penal Code, special laws and this Code.
The territorial collectivity of Martinique is obliged to protect the president of the assembly of Martinique, the vice-presidents, the president of the executive council and the executive councillors against violence, threats or insults of which they may be victims in the course of their duties and to compensate, where appropriate, the harm that has resulted.
The collectivity is subrogated to the rights of the victim to obtain from the perpetrators of these offences the restitution of sums paid to the elected official concerned. It also has a direct right of action for the same purposes, which it may exercise, if necessary by bringing a civil action, before the criminal court.
