Article L7222-3 of the French General Code of Local Authorities

Any councillor to the Assembly of Martinique who, without a valid excuse, has refused to carry out one of the functions devolved upon him by the laws shall be declared to have resigned by the Council of State. The refusal results either from an express declaration addressed to those entitled or made public by its author, or from persistent abstention after warning from the authority responsible for convening.

The councillor thus resigning may not be re-elected before the period of one year.

Tout conseiller à l’assemblée de Martinique qui, sans excuse valable, a refusé de remplir une des fonctions qui lui sont dévolues par les lois est déclaré démissionnaire par le Conseil d’Etat. Le refus résulte soit d’une déclaration expresse adressée à qui de droit ou rendue publique par son auteur, soit de l’abstention persistante après avertissement de l’autorité chargée de la convocation.

Le conseiller ainsi démissionnaire ne peut être réélu avant le délai d’un an.
