Article L731-3 of the French Code governing the entry and residence of foreign nationals and the right of asylum

The administrative authority may authorise a foreign national who proves that it is impossible to leave French territory or that he/she is unable to return to his/her country of origin or to go to any other country, to remain temporarily in the territory by placing him/her under house arrest until there is a reasonable prospect of his/her obligation being fulfilled, in the following cases:
1° The foreign national is the subject of a decision imposing an obligation to leave French territory for which the period for voluntary departure has expired or has not been granted;
2° The foreign national must be removed to enforce a ban on returning to French territory pursuant to articles L. 612-6, L. 612-7 and L. 612-8;
3° The foreign national must be removed to implement a decision taken by another State, pursuant to Article L. 615-1;
4° The foreign national must be handed over to the authorities of another State pursuant to Article L. 621-1;
5° The foreign national must be removed to enforce a travel ban on French territory pursuant to Article L. 622-1;
6° The foreign national is the subject of a deportation order;
7° The foreign national must be deported in execution of a judicial deportation order issued in application of the second paragraph of article 131-30 of the penal code;
8° The foreign national must be deported in execution of an administrative deportation order.
The detailed rules for the application of this article are laid down by decree in the Conseil d’Etat.

Article L731-3

L’autorité administrative peut autoriser l’étranger qui justifie être dans l’impossibilité de quitter le territoire français ou ne pouvoir ni regagner son pays d’origine ni se rendre dans aucun autre pays, à se maintenir provisoirement sur le territoire en l’assignant à résidence jusqu’à ce qu’existe une perspective raisonnable d’exécution de son obligation, dans les cas suivants :
1° L’étranger fait l’objet d’une décision portant obligation de quitter le territoire français pour laquelle le délai de départ volontaire est expiré ou n’a pas été accordé ;
2° L’étranger doit être éloigné en exécution d’une interdiction de retour sur le territoire français en application des articles L. 612-6, L. 612-7 et L. 612-8 ;
3° L’étranger doit être éloigné pour la mise en œuvre d’une décision prise par un autre État, en application de l’article L. 615-1 ;
4° L’étranger doit être remis aux autorités d’un autre Etat en application de l’article L. 621-1 ;
5° L’étranger doit être éloigné en exécution d’une interdiction de circulation sur le territoire français en application de l’article L. 622-1 ;
6° L’étranger fait l’objet d’une décision d’expulsion ;
7° L’étranger doit être éloigné en exécution d’une peine d’interdiction judiciaire du territoire prononcée en application du deuxième alinéa de l’article 131-30 du code pénal ;
8° L’étranger doit être éloigné en exécution d’une interdiction administrative du territoire français.
Les modalités d’application du présent article sont fixées par décret en Conseil d’Etat.
