A foreign national sentenced to deportation from French territory for acts of terrorism under Title II of Book IV of the Criminal Code, or subject to a deportation order issued for behaviour related to terrorist activities, and who is placed under house arrest pursuant to 6° or 7° of article L. 731-3 or article L. 731-4 may be placed under mobile electronic surveillance.
This placement is ordered by the administrative authority, with the foreign national’s agreement, for a period of three months. This initial period may be extended for the same length of time, provided that the total duration of the placement does not exceed two years. In the absence of an extension, the placement under mobile electronic surveillance will be terminated.
For the entire duration of the placement, the foreign national will be required to wear a device incorporating a transmitter enabling his or her location throughout France to be determined remotely at any time.
The implementation of the technical device enabling remote monitoring may be entrusted to an authorised private-law person under conditions laid down by decree in the Conseil d’Etat.
During the period of placement, the administrative authority may, of its own motion or at the request of the foreign national, amend or supplement the obligations resulting from the said placement.
