Article L733-7 of the French Code governing the entry and residence of foreign nationals and the right of asylum

When the voluntary obstruction of the foreign national referred to in article L. 733-6 prevents him or her from being taken to the consular authorities, the administrative authority may, after duly noting this obstruction, ask the liberties and detention judge to authorise it to request the police or gendarmerie units to visit the foreign national’s home. The purpose of this visit is to ensure that the foreign national is present, to take him or her to the consular authorities and, if the conditions are met, to notify him or her of the decision to place him or her in detention.
For the application of the first paragraph, the liberty and custody judge shall ensure that the foreign national is voluntarily obstructing the request to be presented to the consular authorities. This obstruction results from the foreign national’s failure, without a legitimate reason, to appear before the consular authorities in order to prepare for the enforcement of the removal order. In this case, the procedure set out in articles L. 733-9 to L. 733-12 will apply.

Article L733-7

Lorsque l’obstruction volontaire de l’étranger mentionné à l’article L. 733-6 fait obstacle à ce qu’il soit conduit auprès des autorités consulaires, l’autorité administrative peut, après avoir dûment constaté cette obstruction, demander au juge des libertés et de la détention de l’autoriser à requérir les services de police ou les unités de gendarmerie pour qu’ils visitent le domicile de l’étranger. Cette visite a pour but de s’assurer de la présence de l’étranger, de le conduire auprès des autorités consulaires et, si les conditions en sont remplies, de lui notifier une décision de placement en rétention.
Pour l’application du premier alinéa, le juge des libertés et de la détention s’assure de l’obstruction volontaire de l’étranger à la demande de présentation aux autorités consulaires. Cette obstruction résulte de la non-présentation, sans motif légitime, aux autorités consulaires en vue de préparer l’exécution de la décision d’éloignement. Il est alors procédé comme il est dit aux articles L. 733-9 à L. 733-12.
