Article L7343-13 of the French Labour Code

When the representative appointed pursuant to Article L. 7343-12 uses a platform as a self-employed worker to carry out his professional activity, the commercial contract may only be terminated at the initiative of the platform after authorisation by the Employment Platforms Labour Relations Authority referred to in Article L. 7345-1.

This authorisation is also required when the self-employed worker has demonstrated that the platform was aware of his imminent appointment as representative, as well as during the six months following the expiry of the representative’s mandate.

Authorisation is given when the planned termination is not related to the representative duties performed by the employee.

Lorsque le représentant désigné en application de l’article L. 7343-12 recourt, comme travailleur indépendant, à une plateforme pour l’exercice de son activité professionnelle, la rupture du contrat commercial ne peut intervenir à l’initiative de la plateforme qu’après autorisation de l’Autorité des relations sociales des plateformes d’emploi mentionnée à l’article L. 7345-1.


Cette autorisation est également requise lorsque le travailleur indépendant a fait la preuve que la plateforme a eu connaissance de l’imminence de sa désignation en tant que représentant, ainsi que durant les six mois suivant l’expiration du mandat de représentant.


L’autorisation est délivrée lorsque la rupture envisagée n’est pas en rapport avec les fonctions représentatives exercées par le travailleur.
