Article L742-7 of the French Consumer Code

The opening judgment entails, until the closing judgment, the suspension and prohibition of enforcement proceedings initiated against the debtor’s assets as well as assignments of remuneration granted by the debtor and relating to debts other than maintenance debts. It also suspends measures for eviction from the debtor’s home, with the exception of those based on an auction judgement issued in respect of seizure of property as well as those ordered on the basis of the third paragraph of article 2198 of the Civil Code.

Le jugement d’ouverture entraîne, jusqu’au jugement de clôture, la suspension et l’interdiction des procédures d’exécution diligentées à l’encontre des biens du débiteur ainsi que des cessions de rémunération consenties par celui-ci et portant sur les dettes autres qu’alimentaires. Il entraîne également la suspension des mesures d’expulsion du logement du débiteur, à l’exception de celles fondées sur un jugement d’adjudication rendu en matière de saisie immobilière ainsi que de celles ordonnées sur le fondement du troisième alinéa de l’article 2198 du code civil.
