Article L742-9 of the French Code governing the entry and residence of foreign nationals and the right of asylum

If the removal decision is overturned by the administrative judge, the foreign national’s detention is immediately terminated. A temporary residence permit will be issued until the administrative authority has made a new decision on the foreign national’s case.

Si la décision d’éloignement est annulée par le juge administratif, il est immédiatement mis fin au maintien de l’étranger en rétention. Une autorisation provisoire de séjour lui est fournie jusqu’à ce que l’autorité administrative ait à nouveau statué sur son cas.
