Article L743-2 of the French Code governing the entry and residence of foreign nationals and the right of asylum

At any time, the liberties and detention judge may, after having given the administrative authority the opportunity to present its observations, on his own initiative or at the request of the public prosecutor, decide to release the foreign national held in detention when the legal or factual circumstances justify it, subject to the exclusive jurisdiction of the administrative judge over the decision to hold an asylum seeker in detention.

Article L743-2

A tout moment, le juge des libertés et de la détention peut, après avoir mis l’autorité administrative en mesure de présenter ses observations, de sa propre initiative ou à la demande du ministère public, décider la mise en liberté de l’étranger maintenu en rétention lorsque les circonstances de droit ou de fait le justifient, sous réserve de la compétence exclusive du juge administratif sur la décision de maintien en rétention d’un demandeur d’asile.
