Article L743-5 of the French Code governing the entry and residence of foreign nationals and the right of asylum

When a case is referred to the liberty and custody judge by the foreign national for the purpose of contesting the decision to place him/her in detention pursuant to article L. 741-10 and by the administrative authority for the purpose of extending detention pursuant to article L. 742-1, the hearing shall be common to both proceedings, which shall be decided by a single order.

Lorsque le juge des libertés et de la détention est saisi par l’étranger aux fins de contestation de la décision de placement en rétention en application de l’article L. 741-10 et par l’autorité administrative aux fins de prolongation de la rétention en application de l’article L. 742-1, l’audience est commune aux deux procédures, sur lesquelles il est statué par ordonnance unique.
