Article L744-11 of the French Code governing the entry and residence of foreign nationals and the right of asylum

When a foreign national is sentenced at first instance to a deportation order as a principal penalty with provisional enforcement and the deportation takes place before the date of the appeal hearing, his or her lawyer will be heard at this appeal hearing if he or she so requests. The same applies to the court-appointed lawyer when the foreign national has requested the benefit of counsel in his appeal petition.

Lorsqu’un étranger est condamné en première instance à une peine d’interdiction du territoire français à titre de peine principale assortie de l’exécution provisoire et que l’éloignement du territoire a lieu avant la date de l’audience d’appel, son avocat est entendu lors de cette audience d’appel s’il en fait la demande. Il en est de même de l’avocat commis d’office lorsque l’étranger a demandé le bénéfice d’un conseil dans sa requête d’appel.
