Article L752-2 of the French Consumer Code

As soon as a debtor applies to a personal over-indebtedness commission, it informs the Banque de France for the purposes of registration in the file.

The same obligation is incumbent on the registry of the judicial court when, on an appeal by the interested party against an admissibility decision made by the commission, the situation referred to in Article L. 711-1 is recognised by this judge or when the debtor has benefited from the cancellation of debts resulting from personal recovery pursuant to the provisions of articles L. 741-2, L. 741-6, L. 741-7 ou L. 742-22.

Dès qu’une commission de surendettement des particuliers est saisie par un débiteur, elle en informe la Banque de France aux fins d’inscription au fichier.

La même obligation pèse sur le greffe du tribunal judiciaire lorsque, sur recours de l’intéressé contre une décision de recevabilité rendue par la commission, la situation mentionnée à l’article L. 711-1 est reconnue par ce juge ou lorsque le débiteur a bénéficié de l’effacement des dettes résultant d’un rétablissement personnel en application des dispositions des articles L. 741-2, L. 741-6, L. 741-7 ou L. 742-22.
