Article L761-1 of the French Consumer Code

The benefit of the provisions of this book shall be forfeited:

1° Any person who has knowingly made false declarations or submitted inaccurate documents;

2° Any person who has embezzled or concealed or attempted to embezzle or conceal, all or part of his assets ;

3° Any person who, without the agreement of their creditors, the commission or the judge, has increased their indebtedness by taking out new loans or will have carried out acts of disposal of their assets during the course of the procedure for handling the overindebtedness situation or personal recovery or during the implementation of the plan or measures provided for in Article L. 733-1 or Article L. 733-4.

Est déchue du bénéfice des dispositions du présent livre :


1° Toute personne qui a sciemment fait de fausses déclarations ou remis des documents inexacts ;


2° Toute personne qui a détourné ou dissimulé ou tenté de détourner ou de dissimuler, tout ou partie de ses biens ;


3° Toute personne qui, sans l’accord de ses créanciers, de la commission ou du juge, a aggravé son endettement en souscrivant de nouveaux emprunts ou aura procédé à des actes de disposition de son patrimoine pendant le déroulement de la procédure de traitement de la situation de surendettement ou de rétablissement personnel ou pendant l’exécution du plan ou des mesures prévues à l’article L. 733-1 ou à l’article L. 733-4.
