Article L761-8 of the French Code governing the entry and residence of foreign nationals and the right of asylum

For the application of this book in Mayotte:
1° Articles L. 700-2, L. 722-7, L. 722-12, L. 732-8, L. 743-20, L. 751-1 to L. 751-13, L. 754-2, L. 754-4 and L. 754-5 are not applicable;
2° References to the Court of Appeal are replaced by a reference to the Appeal Chamber of the Court of Appeal of Saint-Denis de La Réunion in Mamoudzou;
3° A paragraph is added to Article L. 711-2 as follows:
“In Mayotte, foreign nationals may not benefit from assisted return but, in exceptional circumstances and subject to the existence of a viable economic project, assistance with economic reintegration, or, if accompanied by one or more minor children, support measures, under conditions defined by order of the Minister of the Interior and the Minister responsible for Overseas Territories. 4° In article L. 732-7, the words: “and, where applicable, on the possibility of benefiting from assisted return” are deleted; 5° In articles L. 741-1, L. 741-2, L. 741-10 and L. 742-1, the words: “forty-eight hours” are replaced by the words: “five days”; 6° In article L. 742-3, the words: “forty-eight hours” are replaced by the words: “five days”; 7° In article L. 742-4, the words: “forty-eight hours” are replaced by the words: “five days”; 8° In article L. 742-4, the words: “forty-eight hours” are replaced by the words: “five days”. 742-3, the words: “twenty-eight days” and the words: “forty-eight hours” are replaced by the words: “twenty-five days” and “five days” respectively;
7° Article L. 743-4 reads as follows:

“Art. L. 743-4 -When five days have elapsed since the decision to place the person in detention, the liberty and custody judge shall be asked to extend the period of detention.
“The liberties and detention judge shall rule, by order, within twenty-four hours of the referral. “

8° In article L. 743-16, the words: “and, where applicable, on the possibility of benefiting from assisted return” are deleted.

Article L761-8

Pour l’application du présent livre à Mayotte :
1° Les articles L. 700-2, L. 722-7, L. 722-12, L. 732-8, L. 743-20, L. 751-1 à L. 751-13, L. 754-2, L. 754-4 et L. 754-5 ne sont pas applicables ;
2° Les références à la cour d’appel sont remplacées par la référence à la chambre d’appel de la cour d’appel de Saint-Denis de La Réunion à Mamoudzou ;
3° L’article L. 711-2 est complété par un alinéa ainsi rédigé :
” A Mayotte, l’étranger ne peut bénéficier d’une aide au retour mais, dans des circonstances exceptionnelles et sous réserve de l’existence d’un projet économique viable, d’une aide à la réinsertion économique, ou, s’il est accompagné d’un ou plusieurs enfants mineurs, de mesures d’accompagnement, dans des conditions définies par arrêté du ministre de l’intérieur et du ministre chargé des outre-mer. ” ;
4° A l’article L. 732-7, les mots : ” et, le cas échéant, sur la possibilité de bénéficier d’une aide au retour ” sont supprimés ;
5° Aux articles L. 741-1, L. 741-2, L. 741-10 et L. 742-1, les mots : ” quarante-huit heures ” sont remplacés par les mots : ” cinq jours ” ;
6° A l’article L. 742-3, les mots : ” vingt-huit jours ” et les mots : ” quarante-huit heures ” sont respectivement remplacés par les mots : ” vingt-cinq jours ” et ” cinq jours ” ;
7° L’article L. 743-4 est ainsi rédigé :

” Art. L. 743-4.-Quand un délai de cinq jours s’est écoulé depuis la décision de placement en rétention, le juge des libertés et de la détention est saisi aux fins de prolongation de la rétention.
” Le juge des libertés et de la détention statue, par ordonnance, dans les vingt-quatre heures suivant sa saisine. ”

8° A l’article L. 743-16, les mots : ” et, le cas échéant, sur la possibilité de bénéficier d’une aide au retour ” sont supprimés.
