In the event of provisional suspension, prohibition or striking off, one or more provisional administrators, appointed and remunerated under conditions laid down by decree in the Conseil d’Etat, may alone carry out professional acts, continue the execution of current mandates or be appointed to carry out, for the duration of the provisional suspension, new mandates entrusted by the courts.
Where the provisional administrator finds that the banned, struck off or suspended judicial administrator is in a state of cessation of payments, he must, after informing the judge who appointed him and the Conseil national des administrateurs judiciaires et des mandataires judiciaires, apply to the competent court for the opening of receivership or compulsory liquidation proceedings.
Within three months of the expiry of his mission, the provisional administrator shall ask the competent court to appoint another judicial administrator to carry out the mandates in progress.
