The Labour Inspectorate control officers mentioned in Article L. 8112-1 and assimilated control officers record infringements in official reports, which are valid until proven otherwise.
These reports are sent to the public prosecutor. A copy is also sent to the representative of the State in the département.
Before forwarding the report to the public prosecutor, the enforcement officer informs the person named in the report of the facts that may constitute a criminal offence and of the penalties incurred.
When he finds infringements for which an administrative fine is provided for in Title V of Book VII of Part Four or in Article L. 8115-1, the Labour Inspection inspector may, if he has not drawn up an official report for the attention of the public prosecutor, send a report to the competent administrative authority, under the procedure provided for in Chapter V of this Title.
