Article L821-1 of the French Code governing the entry and residence of foreign nationals and the right of asylum

It is punishable by one year’s imprisonment and a fine of €3,750 for a foreign national to enter mainland France:
1° Without fulfilling the conditions mentioned in points a, b or c of paragraph 1 of Article 6 of Regulation (EU) No 2016/399 of the European Parliament and of the Council of 9 March 2016 on a Union Code on the rules governing the movement of persons across borders (Schengen Borders Code) and without having been admitted to the territory pursuant to points a and c of paragraph 5 of Article 6 of the same Regulation;<2° While he was the subject of an alert for the purposes of refusing entry pursuant to an enforceable decision taken by one of the other States party to the Schengen Convention signed on 19 June 1990.
A foreigner convicted under this article is liable to an additional three-year ban from French territory.
For the application of this article, public proceedings may only be instituted when the facts have been established in the circumstances set out in article 53 of the Code of Criminal Procedure.

Article L821-1

Est puni d’un an d’emprisonnement et de 3 750 euros d’amende le fait, pour un étranger, de pénétrer sur le territoire métropolitain :
1° Sans remplir les conditions mentionnées aux points a, b ou c du paragraphe 1 de l’article 6 du règlement (UE) n° 2016/399 du Parlement européen et du Conseil du 9 mars 2016 concernant un code de l’Union relatif au régime de franchissement des frontières par les personnes (code frontières Schengen) et sans avoir été admis sur le territoire en application des points a et c du paragraphe 5 de l’article 6 de ce même règlement ;
2° Alors qu’il faisait l’objet d’un signalement aux fins de non-admission en application d’une décision exécutoire prise par l’un des autres Etats parties à la convention signée à Schengen le 19 juin 1990.
L’étranger condamné en application du présent article encourt la peine complémentaire de trois ans d’interdiction du territoire français.
Pour l’application du présent article, l’action publique ne peut être mise en mouvement que lorsque les faits ont été constatés dans les circonstances prévues à l’article 53 du code de procédure pénale.
