The High Council may communicate confidential information to the Autorité des marchés financiers, the Autorité de contrôle prudentiel et de résolution, the Autorité de la concurrence, the Banque de France, the European System of Central Banks, the European Central Bank and the European Systemic Risk Board, where such information is intended for the performance of their tasks under Regulation (EU) of 16 April 2014.
It may request these same authorities to provide it with any information necessary for the performance of its tasks.
The information transmitted shall be covered by professional secrecy under the conditions applicable to the authority that communicated it and to the recipient authority.
This information may only be used by the receiving authority for the performance of its duties. Where, in the course of its duties, the receiving authority communicates the information thus obtained to third parties, it shall take account of the legitimate interest of undertakings in the protection of their business secrets, without prejudice to the article L. 463-4 of the French Commercial Code.
