The commission mentioned in article L. 822-4 may obtain any information or consult on site any documents that it considers useful for carrying out its duties, without being able to oppose the articles 226-13 and 226-14 of the Penal Code or article L. 1227-1 of the Labour Code.
The Chairman of the Commission may, by reasoned decision, summon or have summoned by the members of the Commission or by agents of the Institut National de la Consommation appointed by the Director General of the Institut National de la Consommation, any person likely to be able to provide them with information concerning cases referred to the Commission. Any person summoned has the right to be assisted by counsel of his or her choice.
Before issuing opinions, the committee hears the persons concerned, except in urgent cases. In any event, it hears the professionals concerned. It shall carry out any necessary consultations.
When, in order to carry out its duties, the committee must take cognisance of information falling within the scope of manufacturing or business secrecy, it appoints a rapporteur from among its members. The rapporteur is provided with all relevant documents and informs the committee of the information obtained.
