Article L8222-2 of the French Labour Code

Any person who disregards the provisions of article L. 8222-1, as well as any person convicted of having used, directly or through an intermediary, the services of a person who performs undeclared work, is jointly and severally liable with the person who has been the subject of an official report for the offence of undeclared work:

1° To the payment of taxes and compulsory contributions as well as penalties and increases owed by the latter to the Treasury or social protection bodies;

2° Where applicable, reimbursement of sums corresponding to the amount of public aid received;

3° Payment of remuneration, allowances and charges owed by it in respect of the employment of employees who have not been subject to one of the formalities provided for in articles L. 1221-10, relating to the declaration prior to recruitment, and L. 3243-2, relating to the issue of pay slips.

Article L8222-2

Toute personne qui méconnaît les dispositions de l’article L. 8222-1, ainsi que toute personne condamnée pour avoir recouru directement ou par personne interposée aux services de celui qui exerce un travail dissimulé, est tenue solidairement avec celui qui a fait l’objet d’un procès-verbal pour délit de travail dissimulé :

1° Au paiement des impôts, taxes et cotisations obligatoires ainsi que des pénalités et majorations dus par celui-ci au Trésor ou aux organismes de protection sociale ;

2° Le cas échéant, au remboursement des sommes correspondant au montant des aides publiques dont il a bénéficié ;

3° Au paiement des rémunérations, indemnités et charges dues par lui à raison de l’emploi de salariés n’ayant pas fait l’objet de l’une des formalités prévues aux articles L. 1221-10, relatif à la déclaration préalable à l’embauche et L. 3243-2, relatif à la délivrance du bulletin de paie.
