Legal entities found to be criminally liable, under the conditions set out inArticle 121-2 of the French Penal Code, for the offences set out in Articles L. 8224-1 and L. 8224-2 are liable to :
1° A fine, under the conditions set out inarticle 131-38 of the French Penal Code ;
2° The penalties mentioned in 1° to 5°, 8° and 12° of article 131-39 of the same code.
The ban provided for in 2° of article 131-39 of the French Criminal Code applies to the activity in the course of or in connection with which the offence was committed.
3° Posting or broadcasting the sentence, in accordance with the conditions set out in article 131-39 of the Criminal Code.
The additional penalty of displaying or disseminating the decision is mandatory for any person guilty of an offence referred to in article L. 8224-2 of this Code. In such cases, the decision must be posted or circulated for a maximum period of one year by the services of the Minister for Employment on a dedicated website, in accordance with the conditions laid down by decree of the Conseil d’Etat issued after consultation with the Commission nationale de l’informatique et des libertés. However, the court may, in a specially reasoned decision, decide not to impose the penalty referred to in this paragraph in view of the circumstances of the offence and the personality of the offender.
