Article L823-16 of the French Code governing the entry and residence of foreign nationals and the right of asylum

Corporate entities held criminally liable, under the conditions set out in Article 121-2 of the French Criminal Code, for the offences defined in the second paragraph of Article L. 823-11 or in Article L. 823-12 of this Code shall incur, in addition to a fine in accordance with the terms and conditions set out in article 131-38 of the French Penal Code, the penalties set out in 1° to 5° and 9° of article 131-39 of the same code.
The prohibition referred to in 2° of article 131-39 of the French Penal Code shall apply to the activity in the exercise or on the occasion of the exercise of which the offence was committed.

Article L823-16

Les personnes morales déclarées responsables pénalement, dans les conditions prévues à l’article 121-2 du code pénal, des infractions définies au second alinéa de l’article L. 823-11 ou à l’article L. 823-12 du présent code encourent, outre l’amende suivant les modalités prévues à l’article 131-38 du code pénal, les peines prévues aux 1° à 5° et 9° de l’article 131-39 du même code.
L’interdiction visée au 2° de l’article 131-39 du code pénal porte sur l’activité dans l’exercice ou à l’occasion de l’exercice de laquelle l’infraction a été commise.
