Section 2: Marriage contracted or child recognised for the sole purpose of obtaining or causing a foreign national to obtain a residence permit or French nationality

Physical persons convicted under articles L. 823-11 or L. 823-12 are liable to the following additional penalties:1° A residence ban for a maximum of five years;2° A ban, for a maximum of five years, on carrying out the professional or social activity in connection with which the offence was committed, subject to the reservations mentioned in article 131-27 of the Criminal Code.

In addition to the supplementary penalties provided for in article L. 823-13, natural persons convicted under articles L. 823-11 or L. 823-12 shall incur the supplementary penalty of confiscation of all or part of their property, whatever its nature, movable or immovable, divided or undivided.

Foreign nationals convicted under articles L. 823-11 or L. 823-12 may be banned from French territory:1° For up to ten years, in the event of conviction under article L. 823-11;2° Permanently, in the event of conviction under article L. 823-12.
