Article L8256-7 of the French Labour Code

Legal entities found to be criminally liable, under the conditions set out inArticle 121-2 of the French Penal Code, for the offences set out in this chapter, with the exception of Article L. 8256-1, shall be liable to :

1° A fine, under the conditions laid down inarticle 131-38 of the French Penal Code ;

2° The penalties mentioned in 1° to 5°, 8°, 9° and 12° of article 131-39 of the same code.

The ban referred to in 2° of article 131-39 applies to the activity in the course of or in connection with which the offence was committed.

Where a fine is imposed, the court may order that the information referred to in 9° of article 131-39 be published, for a maximum period of two years, by the services of the Minister for Employment on a dedicated website, in accordance with the conditions laid down by decree of the Conseil d’Etat issued after consultation with the Commission nationale de l’informatique et des libertés.

Article L8256-7

Les personnes morales reconnues pénalement responsables, dans les conditions prévues par l’article 121-2 du code pénal, des infractions prévues au présent chapitre, à l’exception de l’article L. 8256-1, encourent :

1° L’amende, dans les conditions prévues à l’article 131-38 du code pénal ;

2° Les peines mentionnées aux 1° à 5°, 8°, 9° et 12° de l’article 131-39 du même code.

L’interdiction mentionnée au 2° de l’article 131-39 porte sur l’activité dans l’exercice ou à l’occasion de l’exercice de laquelle l’infraction a été commise.

Lorsqu’une amende est prononcée, la juridiction peut ordonner que la diffusion prévue au 9° du même article 131-39 soit opérée, pour une durée maximale de deux ans, par les services du ministre chargé du travail sur un site internet dédié, dans des conditions prévues par décret en Conseil d’Etat pris après avis de la Commission nationale de l’informatique et des libertés.
