Article L8271-9 of the French Labour Code

For the purposes of investigating and establishing breaches of the prohibition on undeclared work, inspection officers may ask to see and obtain immediate copies of the following documents, regardless of their form or medium:

1° Documents proving that the registration, declarations and formalities referred to in articles L. 8221-3 and L. 8221-5 have been carried out, as well as those relating to the authorisation to practise the profession or to approval when a specific provision has so provided;

2° Documents proving that the company has verified, in accordance with the provisions of articles L. 8222-1 or L. 8222-4, that its co-contractor(s) have complied with the formalities mentioned in articles L. 8221-3 and L. 8221-5 or regulations of equivalent effect in their country of origin;

3° Estimates, order forms or work orders, invoices and contracts or commercial documents relating to services provided in breach of the provisions of article L. 8221-1;

4° Professional insurance certificates held by self-employed workers where such insurance meets a legal obligation.

Article L8271-9

Pour la recherche et la constatation des infractions aux interdictions du travail dissimulé, les agents de contrôle peuvent se faire présenter et obtenir copie immédiate des documents suivants, quels que soient leur forme et leur support :

1° Les documents justifiant que l’immatriculation, les déclarations et les formalités mentionnées aux articles L. 8221-3 et L. 8221-5 ont été effectuées ainsi que ceux relatifs à l’autorisation d’exercice de la profession ou à l’agrément lorsqu’une disposition particulière l’a prévu ;

2° Les documents justifiant que l’entreprise a vérifié, conformément aux dispositions des articles L. 8222-1 ou L. 8222-4, que son ou ses cocontractants ont accompli les formalités mentionnées aux articles L. 8221-3 et L. 8221-5 ou des réglementations d’effet équivalent de leur pays d’origine ;

3° Les devis, les bons de commande ou de travaux, les factures et les contrats ou documents commerciaux relatifs aux prestations exécutées en méconnaissance des dispositions de l’article L. 8221-1 ;

4° Les attestations d’assurances professionnelles détenues par les travailleurs indépendants lorsque ces assurances répondent à une obligation légale.
