Article L850 of the French Public Health Code

For the purposes of this provision, sick leave and the leave referred to in articles L. 880 and L. 881 are considered as service completed.

The administration retains complete freedom to stagger leave. It may also object, if the interests of the service so require, to any splitting of leave.

Employees with family responsibilities are given priority as far as possible in the choice of annual leave periods.

Leave due for a completed year of service may not be carried over to the following year unless exceptional authorisation is given by the head of department.

Les congés de maladie ainsi que ceux visés aux articles L. 880 et L. 881 sont considérés, pour l’application de cette disposition, comme service accompli.

L’administration conserve toute liberté pour échelonner les congés. Elle peut en outre s’opposer, si l’intérêt du service l’exige, à tout fractionnement de congé.

Les agents chargés de famille bénéficient autant que possible d’une priorité pour le choix des périodes des congés annuels.

Le congé dû pour une année de service accompli ne peut se reporter sur l’année suivante sauf autorisation exceptionnelle donnée par le chef de service.
