Article L934-1 of the French Commercial code

For the application of article L. 450-4 :

1° In the first paragraph, the words: “the European Commission, the Minister for the Economy or the General Rapporteur of the Autorité de la concurrence on a proposal from the Rapporteur” are replaced by the words: “the competent authority of New Caledonia”;

2° In the second paragraph, the words: “of Book IV of this Code” are replaced by the words: “applicable in New Caledonia with regard to freedom of pricing and competition”;

3° In the seventh paragraph, the words: “that of the administration of the Directorate General for Competition, Consumer Affairs and Fraud Control or that of the Competition Authority” are replaced by the words: “or that of the competent administration of New Caledonia. “;

4° In the eighth paragraph, the words: “and, where applicable, the agents and other persons mandated by the European Commission” are deleted;

5° In the eleventh paragraph, the words: “of the Autorité de la concurrence” are replaced by the words: “of the competent administration of New Caledonia”;

6° In the twelfth paragraph, the words: “and at the latest from the notification of grievances provided for in Article L. 463-2” are deleted.

Article L934-1

Pour l’application de l’article L. 450-4 :

1° Au premier alinéa, les mots : ” la Commission européenne, le ministre chargé de l’économie ou le rapporteur général de l’Autorité de la concurrence sur proposition du rapporteur ” sont remplacés par les mots : ” l’autorité compétente de la Nouvelle-Calédonie ” ;

2° Au deuxième alinéa, les mots : ” du livre IV du présent code ” sont remplacés par les mots : ” applicables en Nouvelle-Calédonie en matière de liberté des prix et de concurrence ” ;

3° Au septième alinéa, les mots : ” de celle de l’administration de la direction générale de la concurrence, de la consommation et de la répression des fraudes ou de celle de l’Autorité de la concurrence ” sont remplacés par les mots : ” ou de celle de l’administration compétente de la Nouvelle-Calédonie. ” ;

4° Au huitième alinéa, les mots : ” et, le cas échéant, les agents et autres personnes mandatés par la Commission européenne ” sont supprimés ;

5° Au onzième alinéa, les mots : ” de l’Autorité de la concurrence ” sont remplacés par les mots : ” de l’administration compétente de la Nouvelle-Calédonie ” ;

6° Au douzième alinéa, les mots : ” et au plus tard à compter de la notification de griefs prévue à l’article L. 463-2 ” sont supprimés.
