Article L934-3 of the French Commercial code

For its application in New Caledonia, Article L. 470-4-1 reads as follows:

Art. 470-4-1.-The act by which the public prosecutor gives his agreement to the settlement proposal issued by the administrative authority responsible for prices and competition interrupts the statute of limitations for public action.

Public action is extinguished when the offender has fulfilled the obligations resulting for him from acceptance of the settlement within the time limit set.

Pour son application en Nouvelle-Calédonie, l’article L. 470-4-1 est ainsi rédigé :

Art. 470-4-1.-L’acte par lequel le procureur de la République donne son accord à la proposition de transaction émise par l’autorité administrative chargée des prix et de la concurrence est interruptif de la prescription de l’action publique.

L’action publique est éteinte lorsque l’auteur de l’infraction a exécuté dans le délai imparti les obligations résultant pour lui de l’acceptation de la transaction.
