Article L941-9 of the French Commercial code

Article L. 144-11 is worded as follows:

“Art. L. 144-11 -If, in accordance with territorial regulations, the management lease contract includes a sliding scale clause, a request may be made to revise the rent, notwithstanding any agreement to the contrary, in accordance with the conditions laid down by a resolution of the Assembly of French Polynesia when, as a result of this clause, the rent is increased or decreased by more than a quarter in relation to the price previously set, either contractually or by court order. “

L. 144-11.-Si, conformément à la réglementation territoriale, le contrat de location-gérance est assorti d’une clause d’échelle mobile, la révision du loyer peut, nonobstant toute convention contraire, être demandée selon les conditions fixées par une délibération de l’assemblée de la Polynésie française lorsque, par le jeu de cette clause, ce loyer se trouve augmenté ou diminué de plus du quart par rapport au prix précédemment fixé, contractuellement ou judiciairement. “
