Article LO3445-6-1 of the French General Code of Local Authorities

If the law or Conseil d’Etat decree mentioned in the first two paragraphs of article LO 3445-6 so provide, when the authorisation has been granted until the renewal of the departmental council, it may be extended automatically, once, for a period that may not go beyond the next renewal by reasoned deliberation of the departmental council adopted within six months of its renewal.

The deliberation provided for in the first paragraph of this article is sent to the Prime Minister and to the State representative in the department. Article LO 3445-5 shall apply to this deliberation. It is published in the Journal Officiel in the month following the expiry of the appeal period provided for in the same article LO 3445-5 or the date on which the resolution becomes enforceable pursuant to the said article. It enters into force on the day following its publication.

Si la loi ou le décret en Conseil d’Etat mentionnés aux deux premiers alinéas de l’article LO 3445-6 le prévoient, lorsque l’habilitation a été accordée jusqu’au renouvellement du conseil départemental, elle peut être prorogée de droit, une seule fois, pour une durée ne pouvant aller au-delà du prochain renouvellement par délibération motivée du conseil départemental adoptée dans les six mois suivant son renouvellement.

La délibération prévue au premier alinéa du présent article est transmise au Premier ministre ainsi qu’au représentant de l’Etat dans le département. L’article LO 3445-5 est applicable à cette délibération. Elle est publiée au Journal officiel dans le mois suivant l’expiration du délai de recours prévu au même article LO 3445-5 ou la date à laquelle la délibération devient exécutoire en application dudit article. Elle entre en vigueur le lendemain de sa publication.
