Article LO6221-26 of the French General Code of Local Authorities

The Territorial Council, when one sixth of its members so request, shall deliberate on the creation of a mission of information and evaluation tasked with gathering information on a matter of interest to the local authority or with carrying out an evaluation of a public service of the local authority. The same territorial councillor may not associate himself with such a request more than once a year.

No mission may be created from 1 January of the calendar year preceding the year of the renewal of the territorial council.

The rules of procedure shall lay down the rules for submitting and examining the request for the establishment of the mission, its operating procedures, the procedures for its composition in compliance with the principle of proportional representation, the duration of the mission, which may not exceed six months from the date of the deliberation establishing it, and the conditions under which it shall submit its report to the members of the Territorial Council.

Le conseil territorial, lorsqu’un sixième de ses membres le demande, délibère de la création d’une mission d’information et d’évaluation chargée de recueillir des éléments d’information sur une question intéressant la collectivité ou de procéder à l’évaluation d’un service public de la collectivité. Un même conseiller territorial ne peut s’associer à une telle demande plus d’une fois par an.

Aucune mission ne peut être créée à partir du 1er janvier de l’année civile qui précède l’année du renouvellement du conseil territorial.

Le règlement intérieur fixe les règles de présentation et d’examen de la demande de constitution de la mission, ses modalités de fonctionnement, les modalités de sa composition dans le respect du principe de la représentation proportionnelle, la durée de la mission, qui ne peut excéder six mois à compter de la date de la délibération qui l’a créée, ainsi que les conditions dans lesquelles elle remet son rapport aux membres du conseil territorial.
