The Territorial Council may be seized, by way of petition, of any matter falling within the competence of the collectivity.
The petition may be presented on an individual or collective basis. It must be drawn up in writing, in any form whatsoever, drafted in the same terms and signed by at least 5% of the electors registered on the electoral rolls in Saint-Barthélemy. It must be dated and include the surname, first name, address of each petitioner and their registration number on the electoral roll.
The petition is addressed to the President of the Territorial Council. The Executive Council shall rule on the admissibility of the petition in a reasoned decision, which may be appealed to the Administrative Court.
Where the petition is admissible, the President of the Territorial Council shall report on it to the next session.
