Article LO6252-10 of the French General Code of Local Authorities

By virtue of a deliberation of the Executive Council, the President of the Territorial Council brings actions and defends before the courts in the name of the community.

He may, by delegation of the Territorial Council, be entrusted for the duration of his mandate with bringing legal actions in the name of the community or defending the community in actions brought against it, in cases defined by the Territorial Council. He shall report to the next meeting of the Territorial Council on the exercise of this power.

He may take any protective measures or measures interrupting forfeiture.

En vertu d’une délibération du conseil exécutif, le président du conseil territorial intente les actions et défend devant les juridictions au nom de la collectivité.

Il peut, par délégation du conseil territorial, être chargé pour la durée de son mandat d’intenter au nom de la collectivité les actions en justice ou de défendre la collectivité dans les actions intentées contre elle, dans les cas définis par le conseil territorial. Il rend compte à la plus proche réunion du conseil territorial de l’exercice de cette compétence.

Il peut faire tous actes conservatoires ou interruptifs de déchéance.
